Scope of Application

These Terms and Conditions apply to all business relationships between us and our customers.

Objectives of CatyCloud

IFTM Institute for Telematics in Medicine GmbH, Höhscheider Weg 13, 42699 Solingen, District Court Wuppertal HRB 16456, operates the website caty.cloud and its subdomains. Through the portal, CatyCloud enables CUSTOMERS to access teleconsultation services provided by CONSULTANTS.

Use of the CatyCloud platform is generally free of charge for CUSTOMERS. CONSULTANTS charge CUSTOMERS individual fees, and CatyCloud receives a fee for providing the infrastructure and services.

CatyCloud – the Technology

CatyCloud is a technical platform that facilitates contacts. CatyCloud does not provide consulting services. CatyCloud provides the CUSTOMER and their CONSULTANT with a private, secure consulting room for communication. Information exchange occurs solely between the CUSTOMER and the CONSULTANT.

Application of Terms of Use upon Registration

These Terms of Use apply to all CUSTOMERS and CONSULTANTS using the portal. The term USER or CONSULTANT refers to a natural person who has registered for the technical service of CatyCloud. USERS, for the purpose of these Terms and Conditions, include both CUSTOMERS and CONSULTANTS. By accepting the Terms of Use during registration, USERS acknowledge these conditions as legally binding.

Registration Forms

Access for CUSTOMERS

• The CUSTOMER selects the type of consultation offered by the CONSULTANT.
• The CUSTOMER registers with CatyCloud: They fill out an online form asking for personal data, residence, and email address.
• After opting in to these Terms of Use, the CUSTOMER selects a payment method for the consultation fee.
• CatyCloud sets up a private chat room for the CONSULTANT and CUSTOMER.
• The chat room enables text message exchange and the upload of documents and images for all types of consultations. Optionally, the agreed consultation method between the CUSTOMER and CONSULTANT may also include an audio or video conference. In these cases, CatyCloud establishes a private communication channel.
• The CONSULTANT may delete the chat room after the consultation is completed. The optional audio or video channel will automatically be deleted after the conversation ends.

Access to CONSULTANT Registration

• The CONSULTANT fills out an online form asking for personal information, postal and email addresses, and qualifications.
• After opting in to these Terms of Use, the information is sent to CatyCloud for verification.
• After positive verification of the information, the CONSULTANT is added to the list of CONSULTANTS visible to CUSTOMERS.

Use of the Platform

CatyCloud provides USERS with a platform through which they can exchange and store information. Generally, CatyCloud does not restrict content, but the following limitations apply:

It is prohibited to post or distribute the following content via CatyCloud:

• Commercial and business content of any kind, including third-party offers, solicitations, and activities with commercial intent, such as raffles, lotteries, exchanges, advertisements, or pyramid schemes,
• Erotic contact advertisements,
• Defamatory criticism,
• Denunciations – especially of conflict parties and/or specific companies or individuals,
• Offensive insults,
• Political, religious, racist, pornographic, or discriminatory content,
• Calls or announcements for demonstrations or violence,
• Morally and ethically offensive statements,
• Direct or hidden advertisements for third-party products or services of any kind,
• Links or references to other websites or email addresses,
• Violations of legal regulations.

Consequences of Violations by the USER:

In case of violations of the above Terms of Use, all information or content and the USER’s account may be deleted immediately without prior notice. The violating USER will be excluded from further participation in CatyCloud with immediate effect and without prior notice. This also applies to new registrations of the excluded USER. A virtual ban will be imposed. Claims for damages remain reserved.

Obligations and Claims of the CUSTOMERS

By agreeing to these Terms of Use, the CUSTOMER confirms that

• they have provided or will provide truthful information about themselves.

The CUSTOMER does not have the right to

• require the acceptance of their request by a CONSULTANT, or
• consultation at a specific time.

Obligations of the CONSULTANTS

By agreeing to these Terms of Use, the CONSULTANT confirms that

• they have provided truthful information to CatyCloud during registration,
• CatyCloud is entitled to take legal action in case of intentional false statements,
• they will only charge the CUSTOMER the consultation fees listed on the website for consultations,
• they are responsible for the required documentation and archiving of consultation records according to applicable legal requirements,
• all information about the CUSTOMER’s person and health status is subject to their legal obligation of confidentiality.

Storage of Personal Data

CatyCloud does not store personal data longer than necessary or legally required.

Duration of Use and Termination of Participation in CatyCloud

The USER and CatyCloud may terminate the services at any time without stating reasons. Services can be terminated by USERS through:

• using the deletion functions on the portal
• by declaration in text form. This declaration should be sent to: info.catycloud@iftm.de
• by letter to: IFTM Institut für Telematik in der Medizin GmbH – CatyCloud -, Höhscheider Weg 13, 42699 Solingen

Consequences of termination:

• Deletion of the user account
• Removal of the user ID
• Deletion of the user’s personal data within legal deadlines.

Liability

• CatyCloud is not liable for information or statements made by the CONSULTANTS.
• CatyCloud is not responsible for the documentation and archiving of the CONSULTANTS’ consultation records.
• CatyCloud is not liable for damages incurred by a CUSTOMER in connection with the provision of the platform.
• CatyCloud is entitled to restrict, suspend, or interrupt a USER’s access to the portal for maintenance purposes.

Final Provisions

• CatyCloud has the right to unilaterally change the Terms of Use at any time and inform USERS via the portal or by other means.
• The invalidity of one clause of the Terms of Use does not affect the validity of the other clauses.
• Central European Time (CET/CEST, Berlin) applies to the use of the portal and scheduling of appointments.
